What are the different degrees of domestic violence charges in South Carolina?


Domestic Violence of a High and Aggravated Nature (DVHAN)


This is the most serious type of domestic violence charge, and it involves causing or threatening to cause great bodily injury or death to a household member, using a deadly weapon, attempting to choke or suffocate the victim, or committing the offense in the presence of a minor or while knowing the victim is pregnant. DVHAN is a felony that carries a penalty of up to 20 years in prison

Domestic Violence 1st Degree


This involves causing or threatening to cause moderate bodily injury to a household member, or violating a protection order, while having two or more prior convictions of domestic violence within the past 10 years, or while using a firearm or displaying a weapon in a threatening manner. Domestic Violence 1st Degree is a felony that carries a penalty of up to 10 years in prison.

Domestic Violence 2nd Degree


This involves causing or threatening to cause moderate bodily injury to a household member, or violating a protection order, while having one prior conviction of domestic violence within the past 10 years, or while having a weapon or causing the victim to fear imminent peril. Domestic Violence 2nd Degree is a misdemeanor that carries a penalty of up to 3 years in prison and/or a fine of up to $5,000.

Domestic Violence 3rd Degree


This involves causing or threatening to cause physical harm or injury to a household member, without any aggravating factors. Domestic Violence 3rd Degree is a misdemeanor that carries a penalty of up to 90 days in jail and/or a fine of up to $2,500.
